I think the problem is that if you don't execute someone, you're all in breach of your contract. And if you don't execute the person who you voted for, you're executing someone innocent and that doesn't make sense.
But... it doesn't even clearly say that we have to choose someone to execute every week, does it? Just that we have to go the execution whenever there is one! So I don't think looking for an alternative sentence for this one case without a dead victim would have been a breach!
